Education is not a Fundamental. Education is not a FundamentalThe   federal constitution of the united states of America doesn’t give a right to free Education to its citizens. This right is found in the constitutions of the various states. The states have put provisions in their constitution which   guarantee   free Education through the twelfth grade (Armor, 1995). This provision is popularly referred to as the Education article. This is evidenced in the ruling of the   case San   Antonio Independent School   District v Rodriguez , 411 U.S. 1 in the year 1973. In this case, the united sates supreme court reversed a Texas three - judge District court. In a case instigated in the federal district court for the western District of Texas , where   members of a group called the Edgewood Concerned Parent Association representing   their children   sued several school Districts such as San Antonio,   the judge contented that Education was a fundamental right. The verdict said that Education wa s a fundamental right and therefore discouraged discrimination on the bases of poverty. The parents had claims that the District of Edgewood was poor with a low tax base as compared to other Districts ( Armor, 1995). The case advanced through the legal system up to the supreme court but now with the Texas state as the defendant. The case reached the Supreme court in 1972 with a new set of judges being appointed to listen to it. Justice Lewis Powell actually acted as the swing vote in the case (Armor, 1995). The Verdict in part stated that Education was neither explicitly nor implicitly protected in the constitution and that the state of Texas which was the defendant in the case had failed to create a suspect class related to poverty. The court therefore held that Education was not a fundamental right under the U.S. constitution and therefore leaving it upon the states to determine all matters pertaining Education in their areas of jurisdiction. The supreme court also doesn’t explicitly empower congress to legislate on the subject of Education. This means that most federal education legislation falls under the spending clause of the constitution. This is a clause which empowers congress to tax as well as spend for the general welfare. The constitution however gives stipulations as far as the provision is concerned. It requires   that the provision has to be consistent with other constitutional rights provided by the federal government. These include the fourteenth Amendment’s right to protection under the law and the first Amendments right to the free exercise of, as well as the non establishment of a religion. Incase of any doubt, the network has set up reality shows involving normal people (just like you?) who are wearing, acting, or displaying the product or belief that MTV wants to sell, therefor reinforcing the idea as mainstream cool. The youth today is very concerned with ima ge, and they have experienced acceptance when they trust the views and style that MTV dictates as cool. Irony In Nathan The Wise Essay Nathan the Wise is a call for reexamination among those who consider themselves as having the monopoly on truth while the rest of the world are supposedly living their lives based on false creeds. The misunderstanding among peoples or nations is rooted in this perception. Gotthold Lessing’s play sought to highlight the innate prejudices of his characters’ religious affiliations and subsequently provided a pithy reminder in the form of an irony. â€Å"Ah! Indeed you do not know how closer I shall cling to you henceforth. We must, we will be friends. Despise my nation. We did not choose a nation for ourselves. Are we our nations? What’s a nation then? Were Jews and Christians such, e’er they were men? And have I found in thee one more, to whom It is enough to be a man? (Lessing)† This was Nathan’s response to The Templar on the latter’s perception of Jews. The irony is on the second to the last sentence which implores humanity to be humane or kind to others regardless of what one believed in. Lessing is contrasting people living their lives based on religions and men who are humane kind to their fellowmen. The irony is in our supposition that our beliefs save us, guide our conduct, and teach us to be human. Yet the same precepts tend to make us biased and often cruel to those outside our fold. Indeed everyone is certain that his belief is the truth among many â€Å"lies†. Sometimes it’s this self-righteousness that makes us unjust. A paradox as pointed out by Lessing. It is ironic that a play written more than two centuries still holds true today. IRONY IN TARTUFFE Moliere parodied religiosity through his play, Tartuffe. Moliere created a very witty play of witless characters-with the exception of the servant girl, Dorine and Cleante. The irreverence of the play could explain away its banning during its time. Hypocrisy is personified by Tartuffe as credulity is personified by Orgon. There are gems of literary passages in the play that demonstrate irony. One particular instance was the interjection of Dorine to Orgon who was convincing his surprised mother about Tartuffe’s masquerade. This passage in Act V, Scene V is worth considering: â€Å"You are quite wrong, you have no right to blame him; This action only proves his good intentions. Love for his neighbour makes his virtue perfect; And knowing money is a root of evil, In Christian charity, hed take away Whatever things may hinder your salvation. † Orgon and his family are about to be evicted from their own home by the unscrupulous Tartuffe when this particular dialogue was uttered. He was already at a loss of how Tartuffe could have done this to him. The irrepressible Dorine could not resist jabbing him verbally. To be deprived of one’s property is to be given the chance to be eternally saved since the thing that causes sin is taken away from you. The person robbing you then is in fact doing you a favor and the robbery itself is a result of good intentions. This may be a tongue-in-cheek line but the irony is apparent in the situation where the quest for religiosity has led almost to Orgon’s total material depravity. IRONY IN THE PRINCESS OF CLEVES â€Å"If any other motives than honour and virtue were necessary to induce you to persist in that character you have hitherto worthily sustained; I would tell you, that a reverse of conduct will disturb my happiness in a better world. But should (which Heaven forbid! ) this heavy misfortune be inevitable, I shall welcome death with joy, since it prevents my being witness to your disgrace (Lafayette). † These last words in the deathbed of Madame de Chartres were part of a warning to her daughter of the pitfalls of falling in love while married. Rather than prevent the Princess of Cleves falling in love, it further arouses in her the need to experience what is romantic and for her which obviously she has not found from the Prince of Cleves. Aside from this irony of a warning prodding one to fall into the pit of forbidden love, Madame de Chartres or Madame Lafayette treated us with verbal irony in the last two sentences. She indicated that if the Princess will stray from the marriage path, she will be unhappy. Still she added she might be happy in death since it will prevent her from witnessing that which would bring disgrace to her daughter. This strong admonition is quite consistent with how society looks upon extramarital dalliances. The Princess was only guilty of mental infidelity. Ironically, it was not only her who suffered but her mother, who died of a broken heart, perhaps from a daughter who ignored her; husband, who died of jealousy; the Duc Nemours who suffered emotionally; and finally the Princess herself who entered a convent. Macbeth: Dark, Evil, and Tragic Essays -- Macbeth Character Analysis

â€Å"Macbeth†- A revered play written in the 16th century by the famous playwright: William Shakespeare. The theme of â€Å"Macbeth† is centred on how power and the thirst for it can corrupt a person and lead to their insanity. Power-hungry and manipulating Lady Macbeth, with the help of the prophecies of the three malevolent witches, persuades the eponymous Macbeth to kill his king, so that she can be the queen. But unfortunately, for her, her plans do not ultimately run smoothly. Both Macbeth’s guilty conscience and his wife’s insanity give them away and eventually lead to their down fall. The purpose of this essay is to discuss to what extent Shakespeare portrays Lady Macbeth as a truly evil character throughout the play. From her very opening scene Shakespeare depicts Lady Macbeth as being cold and full of evilness. In act 1 scene 5, Lady Macbeth is introduced reading a letter from Macbeth. Already the audience can see she has evil plans. â€Å"Hie thee hither, That I may pour my spirits in thine ear And chastise with the valour of my tongue.† (Act 1 scene 5) This exhibits that she wants Macbeth to come back home so she can persuade him to do the evil deed. Later in the scene, Lady Macbeth is afraid that Macbeth is too weak and too compassionate to be a murderer, therefore she asks the gods to replace all her goodness and femininity with cold haunted evilness. This is clear when she calls the evil spirits; â€Å"...Unsex me here, Make thick my blood, Stop up th’access and passage to remorse... Come to my woman’s breasts, And take my milk for gall...† (Act 1 scene 5) So that she can poison her husband’s mind. The audience’s first impression of her is as a remorseless, cold evil wife. This prepares the audience for the evilness sh... ...5 scene 5). Power has watered down all his love and kindness. Shakespeare portrayed Lady Macbeth as evil and in the end was driven to death by her own guilt because ultimately she was a human and not a complete monster. Lady Macbeth is thought of being a truly evil character because of the way Shakespeare portrays her character. Her malevolent influence on Macbeth, her trying to hide her humanity to help her have more power over her husband, then her trying very hard to hide her guilt are all examples of the evil she had done. Her dark and sinister nature gradually gave way to insanity and a suicide. Lady Macbeth’s character is a proof that power and thirst for it can lead to insanity and a person’s ultimate down fall. Financial Analysis of Honest Tea Essay

Through Honest Tea’s three years of business, their business shows some positive signs of a promising company. Since Honest Tea is a start-up company, it is understandable that their net income is in the negatives since their expenses will outweigh their sales, but as the three years have gone on, their net income has improved, and even increased by 74% from 1999 to 2000 from -$882,359 to -$228,879, which shows a positive sign of growth. Honest Tea is also very capable to pay back their short term liabilities since their current ratio is a high 5.92. Their profit margin has also increased over the three year period from -71.7% to -36.3% showing positive signs of profit and ability to grow. Honest Tea is able to generate $0.50 for every dollar of assets they have, which isn’t a huge amount, but being in the positive for a start-up company is important. Unfortunately, Honest Tea isn’t very efficient in turning over its inventory since this turnover ratio is less than one, but, for a start up, they are doing well. Revenues increased tremendously from 1998 to 1999, but fell by almost 50% in 2000, so that is worrisome. The debt to equity ratio in 1999 was .241 and it decreased in 2000 to .142. A lower debt to equity ratio usually implies a more financially stable business, so it’s great that the debt to equity decreased from 1999 to 2000. Companies with a higher debt to equity ratio are considered more risky to creditors and investors than companies with a lower ratio. Unlike equity financing, debt must be repaid to the lender and requires debt servicing or regular interest payments. In other words, debt can be a far more expensive form of financing than equity financing. Companies leveraging large amounts of debt might not be able to make the payments. Creditors view a higher debt to equity ratio as risky because it shows that the investors haven’t funded the operations as much as creditors have, so it’s good to see that Honest Tea has been getting more money from investors so they don’t have a large amount of debt. Compared to some other companies in their industry (Triarc Cos Inc, Saratoga  Beverage, National Beverage Corp., Clearly Canadian Beverage, etc.), Honest Tea is far behind. Most of this is due to the fact that Honest Tea is a start-up company and all of these other companies are well established, but these competitors are turning out positive profit margins and positive net incomes which makes it very hard for Honest Tea to compete in the market. 1.) Honest Tea’s sales dropped in 2000, so they are trying to find more capital to keep the company running. The success of the company, before the cold spell in 2000, had drawn a lot of media attention which caused Honest Tea to be featured in Fortune, Entrepreneur, and Beverage World, which definitely helps the company’s reputation, but Honest Tea really needs to get their sales back going in order to stay relevant in the market. 2.) First of all, in the future, Honest Tea need to raise more financing to be successful. They need to find more venture capitalists or angel group in order to support the continuation of the company. Honest Tea also needs to start expanding distribution of their product, but that can only happen if they get the financing to pay for the distribution. They need more distribution so they can pick up more customers that will demand their product, in hopes that either they can grow Honest Tea as its own company, or that it will get picked up as part of another big brand such as Pepsi or Coca Cola. 3.) In order to continue its distribution and growing the company, Honest Tea believes a $2 million round of financing would carry Honest Tea to profitability. 4.) Honest Tea has received financing from many different places. The first financing had come from Goldman and Nalebuff, they would be decent investors but they only have so much money to give to the company. Next, they approached family and friends, they raised around $200,000 for Honest Tea but they wouldn’t be considered the ideal investor because they don’t have enough money to support Honest Tea past their seed stage. Customers of their product have also contributed capital to the company, but these investors have not been the right investors because they are not as sophisticated as  venture capitalists and angels, and don’t necessarily have the experience with interpreting financial statements which means they require a lot of extra time and attention and that takes away from Goldman and Nalebuff’s ability to focus on growing Honest Tea. They also received financing from venture capital groups, which would be a better fit for Honest Tea since the venture groups don’t need as much attention as Honest Tea’s other unexperienced investors but they also demand more control of the company than Honest Tea’s other investors. 5.) Right away with the financing from the family and friends, there wasn’t really a specific structure, but in 1998 Honest Tea established a financing structure. The financings have been structured so that when an investor purchased common stock, the founders were given warrants for creating the company. Honest Tea structured them in this way because Nalebuff though that by including warrants for the founders with exercise prices staged at multiples of the initial price at which family and friends brought in would avoid such disagreements. If the company did well, then they would be able to exercise their warrants and they would own a greater fraction of the company, but if they didn’t, then the original investors would own a larger piece of the firm. 6.) Honest Tea should look for angel investors or venture capitalists, this is because the investors that Honest Tea currently has are very inexperienced when it comes to financial statements, so to have financiers that have experience and knowledge when it comes to investing and finance. Angel investors and venture capitalists also have more access to large amounts of capital and have connections that the current investors do not. 7.) The proposed financing and valuation do make sense because it gives Honest Tea the best chance of the founders maintaining 50% of the equity of the company. Honest Tea is using a warrant based structure, which seems complex, but really it’s a smart way to structure their financing. This type of financing allows Honest Tea to keep founder equity, as long as they meet their goals and targets. If they don’t, more of the equity goes to their investors because they will be issued more shares of the company. This is a  good set-up because it gives Honest Tea’s owners a reason to work hard to meet their goals, and if they don’t the founders will lose their 50% share of the company. The valuation of the company makes sense because it’s based on Honest Tea’s sales of their two products and the value of their bottling plant. If they sell a lot of their products, the valuation of their company goes up. However, if they don’t sell enough of their product, the valuation of the company goes down. If the valuation goes below $15.1 million, then shareholders will be issued more shares and they would get more control over the company. 8.) The ready to drink tea market is looking very promising for Honest Tea. In 1999, the ready to drink tea market totaled $2.67 billion, which was an increase by 9% from 1998. Although this doesn’t seem like a huge market, because the wholesale and retail sales have increased by 9% in just one year, I believe that the market will grow. Experts even projected that the read to drink tea market would more than double in size over the next 10 years, meaning the $2.67 billion market will be an over $5 billion market in a short 10 years. Distribution channels have also been growing, ready to drink tea sales and loose tea bag sales have been growing in other channels such as drug stores, and growing by 21.2% growth in volume sales in mass merchandise, which is outgrowing other forms of drinks such as coffee and bottled juice. Honest Tea’s competitors are national brands; Snapple controls 14.6% of the market, Arizona Iced Tea holds 10.6% of the market, and Lipton represents 9.5% of the market. Honest Tea’s competition/ brand loyalty would be considered one of the barriers to entry; all of Honest Tea’s competition is well established national companies, which means that it would be very hard to compete with them since they have already mastered their distribution around the country and they all have significant control of the ready to drink tea market. Economies of scale is another barrier to entry for Honest Tea, since other companies in the market has a lot of production their average costs fall, but since Honest Tea is a small company their average costs are still large, so they need to work to increase their production to get their average costs down. 9.) Rapid growth is not that important, especially if it causes Honest Tea to  compromise some of their convictions. It would be more beneficial for the company to grow slowly and organically to keep the mission of their company. If a venture capitalist pushes Honest Tea to grow too fast, this may cause Honest Tea to take shortcuts when it comes to being organic and environmentally and economically responsible, which could cause customers to not value the Honest Tea brand as they did when they were growing slowly. So I would say that rapid growth is not important to Honest Tea. However, going national is very important for Honest Tea. Honest Tea needs to go national in order to get brand loyalty, so grocery stores, gas stations, dining establishments, etc., would demand to have Honest Tea in their establishment. Going national would also mean that Honest Tea would have better access to investments or a chance to be acquired by a strategic partner, which is part of Honest Tea’s exit strategy. So going national is a huge part of what Honest Tea wants to accomplish with its company, which means it’s very important to go national. 10.) Honest Tea needs the money for investing in new distribution channels, hiring a nation sales force, purchasing marketing and merchandising materials, gaining capital to support the launch of Honest Tea in new super market chains, and gaining capital to get the Three Rivers Bottling plant to profitability. They need the money as soon as possible because it need to cover operating losses for the next several quarters to keep Honest Tea functioning. 11.) The pro forma projections of Honest Tea do make sense. The pro forma projections take into account the months that ready to drink tea sales may decline due to seasonal preferences, for example since January and February aren’t a time where the market would demand a cold, refreshing drink, Honest Tea has projected those months to have the smallest amount of cases sold. Conversely, the projections also show that the tea bag sales will increase when ready to drink tea decreases. Honest Tea’s projections make sense in the aspect that they take into account the coolers, marketing, travel expenses, etc., that will come with expanding their business. The projections also show how the expenses per month decrease showing that the company is taking economies of scale into consideration, meaning that the  more production they have the average cost will decrease. One aspect of the projections that don’t make sense is how the end of 2001 the company’s net income is in the positive, but once January of 2002 begins, Honest Tea is projecting a huge drop in net income to -$286.1, but besides that, Honest Tea’s projections make sense. 12.) Honest Tea’s financing strategies thus far have not been ideal. They have depended on family, friends, and customers to provide them with capital, and this has caused Seth and Barry to spend much of their time explaining financial statements, searching for more capital, and holding the hands of their inexperienced investors. The current financing has caused Seth and Barry to spend too much time worrying about investments, and not enough time to figure out how to grow the business. Seth and Barry really need to start looking for more professional sources of financing such as angels and venture capitalists.The valuation and financing structure that Seth and Barry have set up for the offering of their shares have provided Honest Tea with a much more organized and reliable financial structure that allows them to not have to spend so much time explaining themselves, which gives them more time to grow their business. 13.) This deal is very attractive to venture capitalists. Honest Tea has a huge market opportunity since they have created a new beverage category that has been on the rise the past couple of years, which would be very attractive to an investor. Honest Tea has also proved that customers are willing to buy their product and even invest in it, which shows they have a following. Another reason this deal is very attractive, is that Honest Tea has received much media attention and received different awards for sustainable practices and packaging, so the product is well known and has the potential to have brand loyalty in the future. Honest Tea also has great management teams that have expertise in the tea industry, and have even worked for companies, such as Sobe, who have rapidly expanded in the past. A great management team is very appealing for a venture capitalist because it means that the VC has to spend less time watching over the company since they already have the expertise that they need to grow. Lastly, Honest Tea is a great venture capital investment because it already has access to its  own bottling plant, so they have no barriers when it comes to mass production. Their bottling plant has the opportunity to provide Honest Tea with approximately $30 million in sales, which is very attractive for an investor. 14.) The deal with the venture capitalist is not attractive for Seth and Barry. First of all, the deal wanted the pre-money valuation of the company to be $5-$7 million, which means that the founders have to give up their proposed 50% control of the company. Falling behind in studies or homework can be detrimental to academic success and can induce stress onto students. Participating in class activities and discussions are also vital parts of learning and applying concepts learned. If you write nonfiction intended to persuade, yes, by a broad definition, you almost certainly are. Here are fifty terms for, and definitions of, forms of propaganda, at least one of which such writers will likely employ in a given piece of content. Propaganda (the word is from a New Latin term meaning â€Å"propagating,† synonymous in this connotation with publicizing) has been defined as â€Å"communication intended to shape perceptions, manipulate cognition, and direct behavior.† That’s a broad definition a narrower one would limit propaganda to willful, prejudicial manipulation of information but it helps writers and readers understand that because almost any content can be considered propaganda, they must be alert to the subtext of almost any content they produce or consume. 1. Ad hominem: attacking opponents rather than opponents’ ideas or principles 2. Ad nauseam: repeating ideas relentlessly so that the audience becomes inured to them 3. Appeal to authority: use of authority figures (or perceived authority figures such as celebrities) to support ideas 4. Appeal to fear: exploitation of audience anxieties or concerns 5. Appeal to prejudice: exploitation of an audience’s desire to believe that it is virtuous or morally or otherwise superior 6. Bandwagon: exploitation of an audience’s desire to conform by encouraging adherence to or acceptance of idea that is supposedly garnering widespread or universal support 7. Beautiful people: depiction of attractive famous people or happy people to associate success or happiness with adherence to an idea or cause or purchase of a product 8. Black-and-white fallacy: presentation of only two alternatives, one of which is identified as undesirable 9. Classical conditioning: association of an idea with another stimulus 10. Cognitive dissonance: using a favorable stimulus to prompt acceptance of an unfavorable one, or producing an unfavorable association 11. Common man: adoption of mannerisms and/or communication of principles that suggest affinity with the average person 12. Cult of personality: creation of an idealized persona, or exploitation of an existing one, as a spokesperson for an idea or a cause 13. Demonizing the enemy: dehumanizing or otherwise denigrating opponents to sway opinion 14. Dictat: mandating adherence to an idea or cause by presenting it as the only viable alternative 15. Disinformation: creating false accounts or records, or altering or removing existing ones, to engender support for or opposition to an idea or cause 16. Door in the face: seeking compliance with a request by initially requesting a greater commitment and then characterizing the desired outcome as a compromise or a minor inconvenience 17. Euphoria: generating happiness or high morale by staging a celebration or other motivating event or offer 18. Fear, uncertainty, and doubt: disseminating false or negative information to undermine adherence to an undesirable belief or opinion 19. Flag waving: appealing to nationalism or patriotism 20. Foot in the door: manipulation by encouraging a small gift or sacrifice, which establishes a bond that can be exploited to extract more significant compliance 21. Glittering generalities: applying emotionally appealing but vague and meaningless words to an idea or cause 22. Half-truth: making a statement that is partly true or only part of the truth, or is otherwise deceptive 23. Inevitable victory: assurance of uncommitted audience members and reassurance of committed audience members that an idea or cause will prevail 24. Join the crowd: communication intended to persuade the audience to support an idea or cause because it is or will be the dominant paradigm 25. Labeling or name-calling: using euphemistic or dysphemistic terms to encourage a positive or negative perception of a person, an idea, or a cause 26. Latitudes of acceptance: introducing an extreme point of view to encourage acceptance of a more moderate stance, or establishing a barely moderate stance and gradually shifting to an extreme position 27. Reductio ad Hitlerum: persuasion of an audience to change its opinion by identifying undesirable groups as adherents of the opinion, thus associating the audience with such groups 39. Repetition: repeated use of a word, phrase, statement, or image to influence the audience 40. Scapegoating: blaming a person or a group for a problem so that those responsible for it are assuaged of guilt and/or to distract the audience from the problem itself and the need to fix it 41. Selective truth: restrictive use of data or facts to sway opinion that might not be swayed if all the data or facts were given 42. Sloganeering: use of brief, memorable phrases to encapsulate arguments or opinions on an emotional rather than a logical level 43. Stereotyping: incitement of prejudice by reducing a target group, such as a segment of society or people adhering to a certain religion, to a set of undesirable traits 44. Straw man: misrepresentation or distortion of an undesirable argument or opinion, or misidentifying an undesirable persona or an undesirable single person as representative of that belief, or oversimplifying the belief 45.
